Once you have taken the decision to separate from your spouse or partner it is important that you receive legal advice in relation to your legal position on various matters concerning divorce proceedings, children’s matters and financial matters.
In England and Wales once you have been married for 1 year you will be entitled to petition for divorce, provided you can prove to the court that your marriage has ‘irretrievably broken down’. That is there is no possibility of reconciliation.
Dissolving Civil Partnerships
The procedure to dissolve a Civil Partnership is exactly the same as the Divorce procedure In England and Wales once you have been in a Civil Partnership for 1 year you will be entitled to petition to dissolve it, provided you can prove to the court that it has ‘irretrievably broken down’. That is there is no possibility of reconciliation.
If there are financial matters to be dealt with as part of your divorce proceedings then these should be dealt with between Decree Nisi and Decree Absolute stage.
It is important when you separate from your spouse or partner that you make suitable arrangements for your children. These arrangements include who the children will live with and how often they will see the other parent.
Adoption and Special Guardianship
Special Guardianship and Adoption are permanent options available for adults, who are not parents to the child.
When you separate it is important to seek legal advice in relation to your position. You may own property or have other financial ties to your ex-partner and you are not sure how these will be severed post-separation.
A pre-nuptial or post-nuptial agreement is a contract between two parties made before of after they enter into marriage or a civil partnership. These type of agreements are increasingly popular, following recent decisions in the higher courts to take these agreements into consideration when a marriage or civil partnership breaks down.
Under the Family Law Act 1996 you can apply to the court for a non-molestation order and/or occupation order against a family member, spouse or ex-partner.
The law on funding family matters, such as divorce, financial matters and children’s matters has recently changed.
Since 6 April 2011 and due to changes in Family Law protocols, before most applications are made to the court in family cases you will need to attend a mediation information meeting.
