Our client, a Formwork Joiner, was working on site when an excavator operative was unloading the steel frames nearby without a banksman. The chains around the steel frames snapped, causing the frame to hit and seriously fracture our client’s ankle. After months of treatment and two operations, he has been left with permanent symptoms.

Our client’s employer and the operative’s employer were in direct breach of Workplace Regulations and their negligence led directly to him sustaining these distressing and disabling injuries. We are pleased that our negotiations have resulted in securing an out of court settlement just before the case went to trial, saving this UCATT member the further distress of a protracted court case”.
